§1 Subject of the Regulations The Regulations set out the rules for the provision of services, liability and stay in the Hotel and are an integral part of the contract, which is concluded by signing the registration card, as well as by making a reservation or paying a deposit or the entire amount due for a stay in the Hotel. By making the above actions, the guest confirms that he has read and accepts the terms of the Regulations. The Regulations are binding for all Guests staying at the Modrzewie Park Hotel*****. The Regulations are available at the Reception desk, in each hotel room, as well as on the Hotel's website The Guest's contact person is the hotel reception, phone ext. 9. §2 Check-in The hotel room is rented for the period of 24 hours. A hotel night lasts from 16:00 to 11:00 the next day. Guests may request an extension of their stay beyond the period indicated on the day of arrival, the Hotel will accommodate the request to extend the stay, depending on room availability. The Hotel reserves the right to refuse to extend the stay of a guest in the case of not making full payment for the current stay. §3 Reservation and registration The basis for registering the Guest is to present an identity document to the receptionist and to sign a registration card. The Hotel Guest is not allowed to transfer the room to a third party, even if the period for which they have paid for the stay has not expired. Persons not renting rooms in the Hotel may guest from 7:00 a.m. to 10:00 p.m. The Hotel may refuse to accept a guest who during the previous stay grossly violated the Rules, especially by causing damage to hotel property or property of guests, damage to the guest, hotel employees or other persons staying at the hotel. The Hotel reserves the right to make a credit card pre-authorization during the registration of the Guest in the amount of payment for the whole stay or its part depending on the purchased offer. Reservations are considered guaranteed, if the advance payment of 50% of the value is made within 3 days from the date of reservation. Lack of prepayment may result in cancellation of the reservation. In case of cancellation of the reservation up to 21 days before the planned arrival, the hotel will return the deposit paid within 14 days of notification of cancellation by the guest. In case of cancellation less than 21 days prior to arrival, the Hotel reserves the right to retain the deposit paid. If you have purchased a non-refundable offer, it is not possible to cancel the reservation. In case of cancellation of the stay by the guest at any time, the entire amount paid is lost. The remaining amount for the stay of the remaining 50% is settled on the day of arrival at the hotel reception by payment in cash or by card. In case of shortening the stay by the guest during its duration there is no possibility of returning the payments made. The guest agrees to issue VAT invoice without signature. §4 Services The Hotel provides services according to its category and standard. In case of any reservations concerning the quality of services, the Guest is requested to report them immediately to the Reception, which will enable the staff to improve the standard of services provided. The Hotel is obliged to provide its Guests with conditions for full and unrestricted rest and safety of their stay, including the safety of keeping information about the Guests confidential. §5 Responsibility of Guests Children under 12 years of age should be on the premises of the Hotel under the constant supervision of legal guardians. Legal guardians are financially responsible for any damage caused by children. Guests are financially responsible for any damage or destruction of equipment and technical devices of the Hotel, resulting from their fault or the fault of their visitors. The Hotel reserves the right to charge the Guest's credit card for the damages caused after the Guest's departure. In case of violation of the provisions of the Rules, the Hotel may refuse to provide services to the person who violates them. Such a person is obliged to immediately comply with the demands of the Hotel, to pay for previous services, to pay for any damage and to leave the Hotel. Each time leaving the room the Guest should check the locking of doors and windows for safety reasons. §6 Hotel's Liability The Hotel is liable for loss of or damage to items brought in by guests to the extent specified by the Civil Code. The Guest should inform the Reception of the occurrence of damage immediately upon its discovery. The Hotel is liable for the loss of or damage to money, securities, valuables, or objects of scientific or artistic value only if such items are placed on deposit at the Reception. The Hotel reserves the right to refuse to accept items of high value, large sums of money, exceeding the possibility of storage in the hotel depository. The Hotel is not responsible for damage or loss of a car or other vehicle belonging to the Guest, items left in it or live animals, regardless of whether these vehicles were parked in the hotel parking lot or in the parking lot in front of the Hotel or in its vicinity. §7 Return of items left in the hotel room Personal belongings left in the hotel room by the guest will be returned to the address indicated by the guest at his expense. If the Guest does not receive such a disposition, the Hotel will store these items at the expense of the owner for a period of three months, after which time the items will become the property of the Hotel. Due to their characteristics, food items will be stored for a period of 24 hours. §8 Curfew The Hotel enforces curfew from 10:00 pm to 7:00 am. §9 Complaints Guests have the right to lodge a complaint if they notice any deficiencies in the quality of services up to the date of departure from the Hotel. All complaints are received by the Reception in writing. The complaint should be lodged immediately after noticing any deficiencies in the standard of services. §10 Additional provisions The hotel accepts the presence of animals on the hotel premises only after accepting the rules of stay of animals in the hotel. Smoking is strictly prohibited in the Hotel and its immediate surroundings except for designated places, designed for this purpose. The hotel rooms are not allowed to store dangerous goods - weapons and ammunition, flammable, explosive and illuminating materials. Canvassing and door-to-door selling is prohibited on the premises of the Hotel. It is forbidden to make excessive noise on the premises of the Hotel or other things that disturb, harm or annoy other guests of the Hotel. Guests are not allowed to make any changes in the hotel rooms and their equipment, other than minor rearrangement of furniture and equipment, not affecting their functionality and safety of use. The Hotel Guests are not allowed to use equipment and objects that may cause a risk of damage to the property of the Hotel and other Guests, especially equipment that may cause fire or flooding. The competent court to resolve disputes between the Hotel Guest and the Hotel is the court with jurisdiction over the defendant. §11 Data Protection In accordance with the General Data Protection Regulation 2016/679 of 27 April 2016. If the guest has consented to the processing of data in order to receive the newsletter Thermaleo Plus - Szczawnica, the administrator processes personal data for this purpose. The legal basis for the processing of personal data is the contract for the provision of hotel services pursuant to Article 6(1)(b) of the RODO, in the case of claim investigation and monitoring - the justified purpose of the controller pursuant to Article 6(1)(f), in the case of fulfilling a tax obligation - a provision of law pursuant to Article 6(1)(c) of the RODO. The legal basis for the processing of the guest's data for the purpose of sending the Thermaleo Plus-Szczawnica newsletter is the consent of the guest on the basis of Article 6(1)(a) RODO. This consent may be withdrawn at any time, which does not affect the validity of the processing that took place before the withdrawal of consent. The controller transfers personal data to the following categories of entities: companies providing IT support services and software delivery, transport and cab companies in the event that the guest orders transport or courier services, law firms providing legal advice and legal representation. Your personal data will be stored in case of: data obtained in connection with the conclusion of a contract for the provision of hotel services - for the period of limitation of tax or civil law claims, depending on which of these events occurs later; data obtained on the basis of consent for the purpose of sending a newsletter - for the period of validity of consent for this purpose; data obtained in connection with monitoring - for 14 days from the date of recording, and then permanently deleted.
